Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Between the 1960s and 1970s, Hélio Oiticica, Lygia Pape and Edgardo Antonio Vigo shared the idea that the audience should stop behaving as a passive spectator to become an active participant in the artistic process. In this case study, we will study how, with this aim in mind, these artists put into practice a series of participatory proposals −most of them in public spaces− which sought to establish a bond with the community. Therefore, these three artist’s artistic proposals involved (...) bodily action, dancing, and intellectual and sensitive stimulus and exploration. Within the framework of both Brazilian and Argentinean dictatorships, as well as of the emergence of revolutionary actions and movements, they fostered an art democratizing ideal in their own way. Resumo: Eu mostro neste artigo que Schopenhauer e Bergson, mesmo abordando o problema da ação livre a partir de pontos de vista filosóficos opostos, concordam em caracterizar as ações humanas de um modo que não é nem determinista, nem compatível com a tese do liberum arbitrium. Schopenhauer, embora equivocadamente tente demonstrar a necessidade de tais ações, é obrigado a reconhecê-las como grundlos e imprevisíveis, enquanto Bergson, embora pretenda mostrá-las como sendo livres, ao final admite que elas não são objeto de (...) uma escolha através da razão. Essa coincidência inesperada entre ambos os filósofos, a respeito do problema da liberdade da ação humana, será explorada neste texto.: I show in this paper that Schopenhauer and Bergson, although approaching the problem of free action from opposed philosophical standpoints, agree in characterizing human actions in a way which is neither determinist nor compatible with the liberum arbitrium thesis. Schopenhauer, although mistakenly trying to demonstrate the necessity of such actions, is obliged to recognize then as grundlos and unpredictable. Bergson, although intending to show such actions as free, in the end admits that they are not a matter of a reasonable choice. It is this unexpected agreement between both philosophers on the problem of the freedom of human action that will be explored in this paper. (shrink)

Tal crítica é norteada especialmente por uma investigação dos critérios morais e normativos das lutas sociais que Honneth recupera, por meio de uma apropriação crítica do pensamento do jovem Hegel. O ponto central defendido por Honneth é que as possibilidades da experiência interativo-comunicativa não podem ser resumidas ou tomadas exclusivamente na interação linguística, nem mesmo esta (...) última pode ser perseguida em seu aspecto ideal, sem a pressuposição dos contextos conflituosos nos quais ela sempre está inserida. O objetivo deste texto é mobilizar a noção de sofrimento social como uma das dimensões estruturantes do fenômeno da pobreza. Para realizar esse trajeto, são apresentados, inicialmente, os contornos mais decisivos do sofrimento social que podem ser mobilizados para realizar o objetivo proposto. Em seguida, apresenta-se uma noção de pobreza construída a partir da crítica à tendência de aproximação, frequente nas poverty theories, entre pobreza e mínimo. Finalmente, no terceiro momento, diferentes níveis de pobreza são articulados às diferentes formas de (...) sofrimento social, com especial atenção para experiências de humilhação. (shrink)

This paper shows that the Freudian “timelessness” of psychical process is not to be understood as a bare consequence of his distinction between conscious and unconscious psychical process. It shows that Freud have a positive and phenomenological characterization of that timelessness, obtained and affirmed beyond and against that distinction, and that the challenge that Freud, with this timelessness, throws to a “Kantian” philosophy is not completely senseless, but can be well worked-out in a somewhat Bergsonian lines.

Resumen:La reflexión sobre el significado de la noción de trabajo tiene desarrollo en la teología brasileña del siglo XX. Para entender el concepto, hacemos una revisión de la literatura académica del período, pensada en paralelo con los hechos históricos relacionados al trabajo y dentro de las distintas comprensiones metodológicas del quehacer teológico de la región. Esta revisión es esencial para alcanzar un status quaestionis de la comprensión de la noción de trabajo en la teología brasileña, pues esta comprensión amplia no (...) estaba hecha. A la vez, el status quaestionis se presenta como necesario para entender cuál es la aportación de la teología brasileña en este tema, es decir, es base para futuros estudios y aporta elementos para la elaboración de un concepto de trabajo basado en la reflexión teológica brasileña. Este artigo apresenta a pertinência do olhar dissidente de Jan Patočka para a atualidade. A partir de sua obra fundamental, tecemos considerações em torno à sua perspectiva fenomenológico-existencial. O intuito é destacar seu engajamento filosófico existencial, a pertinência de suas críticas ao totalitarismo e sua preocupação com o avanço de uma tecnocracia que ameaça a existência humana. Argumenta-se que a postura filosófica do filósofo de Praga torna-se paradigmática para a conjuntura atual e para a práxis filosófica autêntica.

Este artigo procura desenvolver o âmbito da assim chamada ontopolítica como contribuição original do pensamento do G. Deleuze para a filosofia política contemporânea. Com este objetivo, veremos que Deleuze toma o conceito de poder em Foucault e lhe confere alçada ontológica. Este conceito de poder dá acesso a outro elemento importante da filosofia política deleuzeana, ou seja, o estudo dos diagramas históricos do poder nas denominadas sociedades disciplinar e de controle. Com o diagrama de funcionamento das mesmas podemos entender qual (...) o retrato deleuzeano para a democracia em sociedades contemporâneas. Adentrando a ontopolítica deleuzeana, nos dedicaremos aos conceitos de maioria, minoria e devir-minoritário. É neste ponto que se faz o encontro da ontopolítica de Deleuze com a ontologia matemática de Ch. Sanders Peirce. Acontece que os conceitos ontopolíticos de Deleuze, além de sua vinculação com uma ontologia do poder, recebem também um tratamento matemático, tendo em vista certas noções aritméticas (contável e não contável) e geométricas (linhas). As maiorias e minorias são conjuntos contáveis que são atravessados por devires não contáveis. Com isso, chegaremos ao ponto central do presente artigo, onde realizamos uma incursão inicial à imagem dos conceitos de maioria e minoria em Deleuze, com base na teoria das coleções e multidões de C. S. Peirce, principalmente com relação à ontologia matemática nela incluída. Quanto a isso, a principal operação será mostrar de que forma a distinção deleuzeana entre maiorias/minorias contáveis e devir-minoritário não contável pode ser escandida em termos de coleções discretas denominadas enumeráveis, denumeráveis e abnumeráveis ou pós-numeráveis, de acordo com a terminologia de Peirce. En efecto, el contenido semántico de esta aparentemente simple frase está cargado de múltiples significaciones relacionadas con diversos procesos psicosociológicos que se acentúan al referirse al transhumanismo. En 2015 empieza una epidemia causada por el virus del zika en Brasil, siendo luego asociada a problemas teratógenos congénitos. A partir de la sospecha de esta relación, surgen, en dos vertientes, artículos defendiendo el aborto: presentándolo como uno de los tratamientos para las mujeres embarazadas; utilizando la crisis sanitaria y la confusión de la opinión pública como una estrategia para despenalizar el aborto. Las dos vías son injustas al exigir que los recursos ya escasos fuesen destinados al aborto y (...) no a la prevención, tratamiento y cuidados necesarios a los afectados. Se concluye que los datos científicos, en si mismos, son acordes a la inmoralidad del aborto, siendo justamente la falta de rigor científico y/o las cuestiones ideológicas los que lo promueven. Antonio Gramsci (1891--1937) was one of the most original political thinkers in Western Marxism and an exceptional intellectual. This article addresses an open problem in the area of cognitive systems and architectures: namely the problem of handling (in terms of processing and reasoning capabilities) complex knowledge structures that can be at least plausibly comparable, both in terms of size and of typology of the encoded information, to the knowledge that humans process daily for executing everyday activities. Handling a huge amount of knowledge, and selectively retrieve it according to the needs emerging in different situational scenarios, is an important (...) aspect of human intelligence. For this task, in fact, humans adopt a wide range of heuristics (Gigerenzer & Todd) due to their “bounded rationality” (Simon, 1957). In this perspective, one of the requirements that should be considered for the design, the realization and the evaluation of intelligent cognitively-inspired systems should be rep- resented by their ability of heuristically identify and retrieve, from the general knowledge stored in their artificial Long Term Memory (LTM), that one which is synthetically and contextually relevant. This requirement, however, is often neglected. Currently, artificial cognitive systems and architectures are not able, de facto, to deal with complex knowledge structures that can be even slightly comparable to the knowledge heuris- tically managed by humans. In this paper I will argue that this is not only a technological problem but also an epistemological one and I will briefly sketch a proposal for a possible solution. (shrink)

Antonio Negri, one of the world's leading scholars on Baruch Spinoza (1632-1677) and his contemporary legacy, offers a straightforward explanation of the philosopher's elaborate arguments and a persuasive case for his ongoing relevance. Responding to a resurgent interest in Spinoza's thought and its potential application to contemporary global issues, Negri demonstrates the thinker's special value to politics, philosophy, and related disciplines. Negri's work is both a return to and an advancement of his initial affirmation of Spinozian thought in _The (...) Savage Anomaly_. He further defends his understanding of the philosopher as a proto-postmodernist, or a thinker who is just now, with the advent of the postmodern, becoming contemporary. Negri also connects Spinoza's theories to recent trends in political philosophy, particularly the reengagement with Carl Schmitt's "political theology," and the history of philosophy, including the argument that Spinoza belongs to a "radical enlightenment." By positioning Spinoza as a contemporary revolutionary intellectual, Negri addresses and effectively defeats twentieth-century critiques of the thinker waged by Jacques Derrida, Alain Badiou, and Giorgio Agamben.
